If a person has been given medical power of attorney for an individual, they have the right to request access to another person’s medical records.
In addition, individual doctors’ offices and hospitals may have their own policies.
In the case of especially sensitive records, such as behavioral health, substance abuse and HIV/STD records, state law may require additional authorization form.For example, in New York, an additional an authorization/patient request form has to explicitly state that the patient wants the facility to release records containing information on an HIV diagnosis or treatment.
